Petaluma River Craft Beer Festival Terms of Service:

1. Agreement

By purchasing or using a ticket to Petaluma River Craft Beer Festival (the “Event”), you agree to be bound by these Event Ticket Terms & Conditions (the “Terms”). Tickets are issued by Petaluma Valley Rotary Trust, a [501(c)(3) nonprofit] (“Organizer”).

2. Age and ID Requirements

- This is a 21+ event. 

- A valid, governmentissued photo ID is required for entry. 

- No refunds will be provided if you are denied entry for failure to present valid ID or for being under 21.

3. Ticket Purchase and Transfer

- All sales are final except as expressly stated in these Terms. 

- Tickets are only valid if purchased through https://petalumarivercraftbeerfest.org and Shopify.  

- Organizer may set limits on ticket quantities per purchaser. 

- Unless expressly permitted by Organizer in writing, tickets may not be resold for profit, used for unauthorized promotions, or transferred in violation of applicable laws. Organizer may cancel any ticket suspected of fraud, resale, or violation of these Terms without refund.

4. Pricing, Fees, and Payment

- Ticket prices and any applicable service or processing fees will be displayed at checkout. 

- All amounts are in U.S. dollars unless stated otherwise. 

- Organizer is not responsible for bank fees, currency conversion fees, or charges imposed by your payment provider.

5. Entry Conditions and Code of Conduct

- Organizer reserves the right to refuse admission or remove any person whose conduct is, in Organizer’s sole discretion, disorderly, intoxicated, unsafe, or otherwise disruptive, without refund. 

- No outside alcohol, illegal substances, weapons, or dangerous items are permitted. 

- Attendees must comply with all posted rules, instructions of staff and security, and all applicable laws and regulations, including alcohol service laws. 

- Organizer may conduct bag checks or screenings as a condition of entry.

6. Responsible Consumption and Transportation

- Beer tastings are intended for responsible consumption. Overservice is prohibited. 

- Organizer and vendors may refuse service of alcohol to any attendee who appears intoxicated or under 21. 

- Attendees are solely responsible for arranging safe transportation. Do not drink and drive.

7. Event Changes, Cancellation, and Force Majeure

- Organizer may modify the Event program, participating breweries, schedule, or venue at any time, including on the Event date, without obligation to provide a refund, provided the core nature of the Event remains substantially similar. 

- If the Event is canceled in full (and not rescheduled), Organizer will, at its discretion and subject to applicable law, offer either a refund of the ticket price (excluding certain fees that may be nonrefundable) or an equivalent credit for a future event. 

- If the Event is postponed or rescheduled, tickets will generally be honored for the new date; specific options (refund or credit, if any) will be communicated to ticket holders. 

- Organizer is not liable for any failure or delay in performing its obligations due to events beyond its reasonable control (including but not limited to weather, natural disasters, government actions, labor disputes, public health orders, or acts of third parties).

8. No Refunds; Limited Exceptions

- Except where required by law or expressly stated otherwise by Organizer in writing, all ticket sales are final and nonrefundable. 

- Lost, stolen, damaged, or destroyed tickets will not be replaced or refunded. 

- In the event of partial closures, limited capacity, or vendor changes, no refunds or discounts will be provided unless required by law.

9. Assumption of Risk; Release of Liability

- Attendance at the Event involves inherent risks, including but not limited to exposure to alcohol, crowds, weather conditions, and possible hazards on the premises. 

- By attending, you voluntarily assume all risks associated with your participation, including any risk of illness, injury, or property damage. 

- To the fullest extent permitted by law, you hereby release and hold harmless Organizer, its directors, officers, employees, volunteers, agents, sponsors, vendors, and venue owners (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to your attendance at or participation in the Event, except to the extent caused by the gross negligence or willful misconduct of a Released Party.

10. Health and Safety

 

- Attendees must comply with any thencurrent public health guidelines or requirements imposed by Organizer, the venue, or government authorities (including, if applicable, mask, vaccination, or testing requirements). 

- If you feel unwell or have been recently exposed to a contagious illness, you should not attend the Event. Organizer may refuse entry to individuals who appear ill or pose a health risk to others, without refund, consistent with applicable law.

11. Photography, Video, and Use of Likeness

- The Event may be photographed, recorded, or livestreamed by Organizer or its partners. 

- By attending, you grant Organizer a nonexclusive, royaltyfree, worldwide license to use your image, likeness, and voice captured at the Event in promotional or informational materials in any media, without further notice or compensation, to the extent permitted by law.

12. Prohibited Items and Activities

Examples you can list and tailor:

- Outside alcohol, glass containers, illegal drugs, and drug paraphernalia. 

- Weapons or objects that could be used as weapons. 

- Unapproved vending, solicitation, or distribution of promotional materials. 

- Unauthorized drones, professional photography/videography equipment, or amplified sound equipment. 

Organizer may update the list of prohibited items or activities at any time.

13. Personal Property

- You are responsible for your personal belongings at all times. 

- Organizer is not responsible for lost, stolen, or damaged property.

 

14. Privacy

- Personal information collected during ticket purchase and attendance will be used in accordance with Organizer’s **Privacy Policy**, available at [link to your privacy policy]. 

- Organizer may share limited information with payment processors, ticketing providers, and necessary vendors strictly to process transactions and operate the Event.

15. Compliance With Law

- You agree to comply with all applicable federal, state, and local laws and regulations while attending the Event, including those relating to alcohol consumption.

16. Limitation of Liability

- To the fullest extent permitted by law, the total aggregate liability of Organizer and the other Released Parties to you for any claims arising out of or related to your ticket or attendance at the Event shall not exceed the amount you actually paid for your ticket. 

- In no event will Organizer or the other Released Parties be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits or lost opportunity, even if advised of the possibility of such damages.

17. Indemnification

You agree to indemnify and hold harmless Organizer and the other Released Parties from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: 

- your breach of these Terms; or 

- your acts or omissions during or in connection with the Event.

18. Miscellaneous

- These Terms are governed by the laws of the State of [California], without regard to its conflictoflaws rules. 

- Any dispute arising out of or relating to these Terms or the Event shall be brought exclusively in the state or federal courts located in [your county, e.g., Sonoma County, California], and you consent to the jurisdiction of such courts. 

- If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

  • Organizer may update these Terms from time to time; the version in effect at the time of your ticket purchase will generally govern, unless changes are required by law.

Petaluma River Craft Beer Festival is a fundraiser for Petaluma Valley and Petaluma Sunrise Rotary using Petaluma Valley Rotary Trust, a 501(c)3.
